This Acceptable Use Policy ("AUP") defines permitted and prohibited uses of the LeadGen-Agent platform. Compliance with this AUP is a condition for maintaining access to the Service. This policy is incorporated into the Terms of Service by reference.
2. Permitted Uses
LeadGen-Agent is designed and appropriate for:
Legitimate B2B commercial prospecting: identifying and making initial contact with businesses that could benefit from the User's products or services.
Commercial research: local market analysis, competitor identification or understanding of a geographic sector.
Sales material generation: creating personalized proposals, presentations and emails for a specific business.
First-touch outreach: sending commercial introduction emails with clear sender identification and an opt-out mechanism.
Commercial follow-up: reminders to leads who did not respond to the first contact, in a reasonable and non-intrusive manner.
3. Prohibited Uses
3.1 Spam and Abusive Communications
The following are prohibited:
Sending unsolicited communications to end consumers (mass B2C campaigns).
Sending more than one email per week to the same recipient without having received a prior reply.
Using misleading subject lines, identity impersonation or domains designed to simulate legitimate companies.
Omitting sender identification, contact address or an opt-out mechanism from any commercial email.
Ignoring, delaying or circumventing opt-out requests from recipients.
Using purchased, leased or scraped email lists from sources other than the Platform itself.
3.2 Illegal or Harmful Activities
The following are prohibited:
Using the Platform to harass, threaten, intimidate, defame or discriminate against persons or businesses.
Collecting or processing special category data without an explicit legal basis (health data, religious beliefs, sexual orientation, biometric data, racial or ethnic origin).
Collecting or processing data of persons under 18 years of age.
Using the Platform for fraudulent activities, scams, phishing or social engineering.
Using the Platform in violation of unfair competition laws or trade secrets.
Infringing third-party intellectual property rights through generated content.
3.3 Technical Abuse of the Platform
The following are prohibited:
Creating multiple accounts to circumvent the active plan's limits.
Attempting to access unauthorized data or functions through exploits, injections or similar techniques.
Intentionally overloading the Platform's infrastructure through mass automated requests.
Using scripts, bots or external tools to automate interactions with the Platform in ways not provided for in the published APIs.
Attempting to reverse engineer, decompile or extract the Platform's source code.
3.4 Misuse of Extracted Data
The following are prohibited:
Selling, assigning, sublicensing or publishing lead data extracted through the Platform to third parties.
Using extracted data for any purpose other than the User's own commercial prospecting.
Combining data from LeadGen-Agent with third-party databases to create extensive profiles of individuals without a legal basis.
Storing or processing lead data outside the Platform in unauthorized systems.
Using Gmail OAuth access for any operation other than sending emails (not technically enabled by the requested permission scope, but explicitly prohibited as policy).
4. Specific Rules for Email Sending
When using the Platform's email sending feature, the User agrees to:
Full identification: include in every email the sender's real name, company name and contact address (physical or postal).
Functional opt-out: include in every email a clear, direct and functional mechanism for the recipient to request no further communications.
Honor opt-outs: stop contacting the recipient within 10 business days of their opt-out request (CAN-SPAM USA) or immediately where law requires (GDPR, EU).
Commercial relevance: ensure the email has a reasonable and verifiable commercial connection to the type of business being targeted.
Graduated volume: respect the daily send limits per plan and follow the warming-up process established by the Platform for new accounts.
No deception: do not use misleading subjects or pretend to be a different person, company or entity than the actual sender.
No unsolicited attachments: on first contact, do not attach files the recipient did not explicitly request.
5. Consequences of Non-Compliance
Non-compliance with this AUP may result, at the Provider's discretion and depending on severity, in:
Written warning by email indicating the specific violation and a deadline to correct it.
Temporary suspension of specific functions (for example, disabling email sending).
Full account suspension without refund of the unconsumed period.
Permanent account termination and prohibition from creating new accounts.
Reporting to authorities if the activity constitutes a criminal, civil or administrative offence.
Cooperation with investigations by data protection authorities or other regulatory bodies.
The Provider may preventively suspend access upon reasonable evidence of a serious or ongoing violation, while the case is being investigated. The User will be notified within a reasonable period.
6. Reporting Misuse
If you detect a use of the Platform that violates this Policy, or if you are a recipient of an email sent through LeadGen-Agent that you consider spam or abusive, you may report it to:
Include in your report: description of the incident, approximate date and, if possible, the email or identification of the sender.
7. Updates to this Policy
This policy may be updated to reflect changes to the Service or applicable law. Notice will be given at least 14 days in advance by email. Changes apply from the date indicated in the notification.
